Scope and Contents
Letter and billing statements from Mike Swanwick. Explaining that the brief and appendix has been filed. The Government will have 60 days to respond with a brief to the Court of Appeals. Swanwick states he has requested oral argument. "It is now the policy of the Fifth Circuit to decide cases without benefit of oral argument unless special reason can be shown and the court agrees to grant such a request. The decision to grant oral argument will not be made until after the Government's brief is filed. In the event that oral argument is granted the Court will set a date and I will appear and make such argument on your behalf. In the event that the request is not granted the Court will so notify me and then it will be a matter of time waiting for a decision - probably 4 or 5 months.
