Scope and Contents
Gentlemen: Enclosed please find a copy of the O'Quinn and Powell v. Alexander cases (see folder 380) which are identical to yours which I tried in the U.S. District Court for the District of Columbia and after losing there, appealed to the U.S. Court of Appeals for the District of Columbia Circuit. As a reading of the decision will reflect, we won in all particulars. The Army is now in the process of deciding whether or not to appeal this decision to the U.S. Supreme Court. They must decide by the end of May. I am sending a copy of this decision to you as information only; it does not directly effect your case, althouh it is very strong authority for the Fifth Circuit Court of Appeals to rely upon. Naturally, I have already sent a copy of this decision to the Fifth Circuit Court of Appeals in New Orleans for inclusion in the record and for consideration by the Judges. The latest I have on your case is that oral argument will be heard by the Fifth Circuit Court of Appeals in the Fall of 1979. Etc.
