Scope and Contents
A federal district court judge in Colubus, GA, has temporarily blocked the separation of a reserve officer passed over for promotion, while a judge here is considering motion for summary judgment in two similar cases. The officers, two captains and a major, are basing their cases on claims that the 1976 Relook promotion process was legally defective. They argue the Army does not have authority to convene retroactive promotion boards and that the Relook panels were in the nature of standby boards. Thus the books could not issue passovers for release from active duty, they argue. In Columbus, Judge J.Robert Elliott has issued a temporary restraining order on behalf of Capt. Gerold Knapp (who was facing imminent separation) until a full hearing can be conducted on his case. Knapp's attorney, Mike Swanwick of Alexandria, LA, said Elliott also will hear the case of Maj. John Foster, a member of the Army Marksmanship Unit and a former Olympic competitor. Note: the Case documents are in Box 3. Beginning with Folder 367.
