Scope and Contents

“I am informed that your office has ruled that Japanese Americans brought to Wyoming by the WRA are not eligible to vote in November even though they are now members of the armed forces. The solicitor’s office in D.C. has asked for more information on the ruling....B. Ver Ploeg, Project Attorney.” Reply from Mart Christensen, Secretary of State: ...”...I wish to advise that this is not a ruling of this office, but a mandate of our last Legislature, the same being Chapter 27, Pg.25, Session Laws of WY, 1943, it being interpreted that members of the armed forces are still legal residents of the Relocation Center, and if they have voting privileges, such votes should be cast in the state of their legal residence before they were brought to WY as temporary residents. However, inasmuch as you have raised the question, and there might be an element of doubt, I am today asking the Attorney General for an official opinion and will advise you accordingly when such opinion is rendered.” Reply from Hal Morris, Deputy Att. Gen.: Quotes Chapter 27, Section 36-111 (see folder 55). And follows with “From this portion of the chapter, it would appear that Japanese Americans who have been interned in Wyoming would be required to qualify as resident electors of Wyoming after the termination of the national emergency by Act of Congress, prior to their being permitted to vote, and their removal from the Heart Mountain Relocation Center to serve in the armed forces would not affect their voting status in Wyoming.
